The MedAlert is a marketing and lead-generation service. We are not a medical alert device manufacturer, retailer, monitoring company, healthcare provider, or insurer. We do not sell, lease, install, or monitor medical alert devices, and we do not provide medical advice. The Site exists to connect consumers who request information with independent third-party companies ("Providers") that offer medical alert devices, monitoring, and related products or services. Any transaction you enter into is solely between you and the Provider.

2. Eligibility

The Site is intended only for users who are at least 18 years old and who reside in the United States. By using the Site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. No Medical Advice

The content on the Site is provided for general informational and marketing purposes only and does not constitute medical, health, legal, or professional advice. Nothing on the Site creates a healthcare provider–patient relationship. Always seek the advice of a qualified physician or other healthcare professional regarding any medical condition or before making decisions about medical alert devices or services. 4. No Endorsement or Guarantee of Providers

We do not endorse, recommend, guarantee, or warrant any Provider, product, service, price, plan, or contract term offered by any third party. We do not control and are not responsible for the products, services, pricing, availability, quality, safety, performance, or business practices of any Provider. Any information about products or services presented on the Site is provided for general illustration only and may not reflect the actual offers, terms, or pricing available to you. You are solely responsible for evaluating, and bear all risk associated with, any Provider you choose to engage.

By submitting your information through the Site, you provide your prior express written consent to be contacted by The MedAlert, Poshnee Tech LLC, and the Providers and marketing partners with whom your information is shared, at the telephone number and email address you provided, using automatic telephone dialing systems, pre-recorded or artificial voice messages, ringless voicemail, text messages, and email, even if your number is on a federal or state "Do Not Call" list. Our total aggregate liability for any claim arising out of or relating to the Site or these Terms shall not exceed one hundred U.S. dollars (US$100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Class Action Waiver

You and Poshnee Tech LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

You may opt out of this arbitration agreement by sending written notice to us at the address below within 30 days of first accepting these Terms.

These Terms and any dispute arising out of or relating to them or the Site shall be governed by the laws of the United States, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision above.

16. Termination
